North Dakota Final Paycheck Law
✓ Verified against official sources · August 31, 2026 N.D.C.C. § 34-14-03
The short answer: North Dakota employers must pay a separated employee — discharged, quit, or suspended in a labor dispute — at the regular established paydays for the periods worked.
If fired
Regular established payday for the period worked
If they quit
Regular established payday for the period worked
Unused PTO
Generally payable at separation — N.D. rules allow only limited exceptions
Penalty for non-compliance: Unpaid wage claims are enforced by the North Dakota Department of Labor and Human Rights under N.D.C.C. ch. 34-14.
Under N.D.C.C. § 34-14-03, whenever an employee is discharged, quits, or is suspended in an industrial dispute, unpaid wages become due and payable at the regular paydays established in advance by the employer for the periods worked — the final check simply rides the normal payroll calendar.
On paid leave, North Dakota's default position is that earned vacation is payable at separation, with limited exceptions the Department of Labor and Human Rights recognizes for employees who leave voluntarily under a restrictive written policy. Wage claims are filed with the department under chapter 34-14.
For employersThe deadline follows your normal payroll calendar, but treat accrued PTO carefully — North Dakota's default is that earned vacation is paid at separation, with narrow policy-based exceptions.
For employeesYour final wages are due on the regular payday for your last pay period. Claims for unpaid wages go to the ND Department of Labor and Human Rights.
