North Carolina PTO Payout Law

✓ Verified against official sources · September 1, 2026 N.C. Gen. Stat. §§ 95-25.12, 95-25.13, 95-25.22
The short answer: North Carolina pays out vacation according to the employer's policy — but vacation cannot be forfeited unless the employee was notified of the forfeiture policy in writing.
Payout at separation
Per policy — promised vacation must be given as time or pay
Use-it-or-lose-it
Works only with written notice of the policy (§ 95-25.13)
What's payable
Vacation due under the policy or practice, with the final wages
Penalty for non-compliance: Unpaid vacation is recovered like unpaid wages: the amount plus interest, and liquidated damages equal to the unpaid sum unless the employer proves good faith (N.C.G.S. § 95-25.22).

North Carolina starts from freedom of contract — § 95-25.12: no employer is required to offer vacation. But once promised, vacation must be given as time off or payment in lieu per the company policy or practice — and, critically, employees "shall be notified in accordance with G.S. 95-25.13" of any policy or practice that results in forfeiture. An employee not so notified is not subject to the forfeiture.

The payout rides the final-wage deadline (next regular payday under § 95-25.7), and unpaid amounts carry the Wage and Hour Act's remedy: the wages plus interest, and liquidated damages equal to the unpaid amount, with a good-faith defense the employer must prove (§ 95-25.22).

For employersAn un-noticed forfeiture clause is a nullity in North Carolina: if employees weren't told in writing that unused vacation is forfeited, it must be paid — and the doubling provision applies to the shortfall.
For employeesCheck what you were given in writing: without written notice of a forfeiture policy, your earned vacation is payable with your final wages on the next regular payday.

North Carolina FAQ

Is use-it-or-lose-it enforceable in North Carolina?
Only if employees were notified of the forfeiture policy in writing per 95-25.13. Without that written notice, earned vacation cannot be forfeited and must be paid.
What can an employee recover for unpaid vacation in NC?
The unpaid amount plus interest, and liquidated damages equal to that amount — effectively double — unless the employer proves the violation was in good faith (95-25.22).
